1. Introduction

Our Company TransferHop, hereinafter referred to as "we", operates through the website transferhop.com, hereinafter referred to as “Website”.

The website visitor, hereinafter referred to as "user", refers to anyone visiting and booking services via the Website.

The company, based in Heraklion, Crete, Greece, with company no 1039E70000427401(EOT), G.C.R. number 154050427000 (G.E.MI.) and VAT 112344466, acts solely as an intermediary providing car transfer booking services from third party providers (hereinafter referred to as Transfer Provider or Provider) who provide professional transport services or who act as an agency with the legal capacity to offer transport services.

TransferHop is free to change or renew the terms relating to the use of its websites at any time without having to notify the user. The general terms of use as they currently stand will be presented on the websites. The user agrees to the necessary adjustment before continuing use. Any prior versions of the listed terms are totally replaced by each modification.

TransferHop solely provides booking services and booking management and not the actual transfer service. Your agreement with us includes the following Terms and Conditions as well as our Privacy Policy (“Agreements”). You acknowledge that you have read and understood the following Agreements, and agree to be bound by them.

By agreeing to these terms, users declare unequivocally that they are of legal age to be bound by these general terms and have obtained all necessary approvals and licenses for their registration on the platform and the use of the service.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please send your feedback by emailing at info@transferhop.com. Below Terms and Conditions apply to all visitors, users and others who wish to access or use Service.

2. Legal Status of the Company

Acting as intermediaries, we connect travelers with drivers. Our platform serves as a mediator for transport services offered by drivers to travelers. It's important to note that we do not directly provide transport services nor are we licensed transport operators. When you book a transport service through our platform, you're entering a contract solely with the drivers. Both you and the driver are responsible for fulfilling the terms of the transport service.

The company does not offer transport services and is not involved in the relationship between you and the driver who picks you up. The contract for transport services is exclusively between you and the driver. The company is not a party to these contracts and assumes no responsibility for the transport provided by drivers. Neither the company nor its representatives are liable for any risks associated with the transactions between travelers and drivers or for any damages resulting from such transactions.

The company does not act as a representative for you or the driver, thus it does not offer any assurances regarding the quality of transport services or the conduct of travelers and drivers. Additionally, the company does not represent or act on behalf of any transport company.

Drivers do not hold an employment status with the company or its partners. The platform simply serves as a means to connect you with drivers. Moreover, the company does not offer insurance coverage for drivers or their vehicles, and it bears no responsibility if you lose personal belongings during a pick-up.

The company may recommend drivers for the provision of transport services, but it does not assess their suitability, legality, or capabilities. By booking transport services, you waive any claims against the company related to the drivers and relieve it of any liabilities or damages. The company does not participate in disputes between you and the drivers. It's acknowledged that the company is not involved in the contractual relationship between you and the driver, but the transport services are governed by the general terms provided.

Our mediation services are exclusively intended for personal, non-commercial use. Therefore, any resale, distribution through deep-linking, copying, tracking (e.g., via spider or scrape techniques), display, downloading, or reproduction of content, information, software, products, or services available on the platform for commercial or competitive purposes is strictly prohibited.

3. The Booking Process & Payment

Before accepting any offers of service, users must carefully read, understand, and agree to these terms & conditions. By accessing any areas of this site, you agree to be legally bound without limitation, qualification or change and abide by these terms and conditions, which will constitute our agreement.

Online Bookings can be made by using our website. The person making the reservation must be at least 18 years old and is in charge of following the online booking procedure in just 3 Steps.

If you wish to book any transfer service available through our website, you may be asked to supply certain information relevant to your Booking including but not limited to, your name, contact tel, email address e.t.c. Your credit or debit card number, the expiration date of your card and your billing address might be asked directly by the payment provider. This information is never requested by our services.

You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to the payment provider is true, correct and complete.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: service availability, errors in the description or price of the service, error in your order or other reasons. We also reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

The booking information that you provide to us will be passed on only to the relevant Provider of your Transport Arrangements or other persons necessary for the provision of your Transport Arrangements.

Upon completing the booking, you will receive a confirmation voucher, which will include all your travel details. Please read it very carefully and double check that all details are correct. This voucher acts as a ‘ticket’ and must be presented to the transfer provider or driver.

All prices are displayed in Euros (€). We reserve the right to amend our prices at any time and also correct errors in both advertised and confirmed prices.

In order to complete the booking procedure, you will either be asked to partially prepay (deposit) or fully pay the total amount of your transfer service. In case of deposit, the exact remaining amount must be paid directly to the driver upon arrival of your pick up either in cash or by credit card.

On completion of your booking, TransferHop will process the booking details and a confirmation voucher will be sent to the provided email address. TransferHop or its providers cannot be held responsible or liable for timeliness, accuracy or quality of the services due to incorrect information provided. It is the user’s responsibility to check that all the details of the booking are correct prior to travel and notify TransferHop of any inaccuracies.

Upon transaction completion your credit card will be charged automatically. Your transaction will show on your statement as “TransferHop”. An instant payment receipt will be sent to your email address (as entered in the booking process) which confirms that the transaction has been completed. This email is automatically sent by the payment gateway.

In case of a partial payment, the driver has the right to refuse the service, should the client not pay the remaining amount, prior to the transfer service.

Please note that any credit/debit card processing fees charged by our payment gateway are non-refundable when you cancel your reservation.

4. Communications

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by emailing us at info@transferhop.com with an unsubscribe request.

5. Services

We do monitor all transport arrivals for any possible delays. The driver will await you upon arrival holding a sign stating your provided name. Please note that the maximum waiting time included in the price is as follows: 60 mins for airport arrivals, 20 mins for ship arrivals and 15 mins for hotel pick ups.

In case you cannot locate the driver upon arrival, please call immediately our emergency helpline, which is stated on your confirmation voucher. If you fail to contact us and organize an alternative transport without informing us, the driver will have to be compensated for his efforts and no refund will be available. In case of partial payment, we will contact you to proceed to the payment of the remaining amount.

In case the driver cannot locate you, your provided mobile phone number will be used by the driver to contact you. Please make sure the provided mobile phone is switched on and operating normally (e.g. deactivate flight mode). If you cannot be reached at the phone number provided, we will not be able to provide the service and no refund will be made.

In general, there will be no refund i) if the client does not supply a valid telephone number and fails to contact our 24hr emergency telephone number (printed on the confirmation email and voucher), resulting in a missed transfer, ii) failing to provide correct travel details (flight numbers, time, etc) might result in missing the transfer, as we will not have correct details to monitor your arrival.  In case of partial payment, we will contact you to proceed to the payment of the remaining amount.

In some destinations (e.g. pedestrian streets) or due to roadwork or any other circumstances you may be dropped off or picked up at a nearby central point within reasonable walking distance from your final destination.

  1. Complaints

If the provided service does not meet your expectations, you should notify our Customer Service by email at info@transferhop.com and provide us with all necessary details so that we can investigate the case.

TransferHop can not be held responsible for any claims exceeding the amount paid for the booking. In the unlikely event that the service is not delivered, the client might only be entitled to compensation up to the amount that has already been paid. No other claims can in any case be raised.

Please note, in all destinations, drivers reserve the right to deny embarkation to the vehicles in the event of inebriated or misbehaved clients. There can not be any refund for these cases and in the event of damages there may be prosecution and damage claims.

  1. Baby/Child Seats

All children and babies, regardless of their age,are considered as a normal passenger and thus should be included in the total number of passengers at the time of booking.            

Both local and national laws regarding the use of child seats for infants and children vary from country to country. During the booking process in most destinations you are given the chance to reserve child or baby seats. Rest assured that we will do everything possible to ensure that the supplier offers these extras when it has been booked. In the very unlikely event where a seat is not provided, you will be refunded the extra cost (if any). If the child/infant seats booked are not available, children over the age of three must use a seatbelt. Children under three years of age may be able to travel without a retention system but mandatory in the rear seats of the vehicle.

  1. Luggage Capacity

The maximum luggage capacity for each vehicle per passenger is 1 medium suitcase which should not exceed 67cm x 45cm x 28cm plus 1 small hand luggage (i.e. handbag) , which fits in the passenger footwell. The passenger will be responsible for any costs incurred in case additional vehicles for the transport of undeclared luggage are required.

The transport of luggage and other personal items is at your own risk. TransferHop and providers will not be liable for any damages or losses.

Unusual requests, not included in the booking engine, are always welcome and our team will endeavor to meet them. Nevertheless, there can't be any guarantee that these requests can be met.

  1. Wheelchairs and Bookings for disabled passengers

Transfer Services for passengers with special needs must be informed by contacting our Customer Service Centre. We will try our best to meet your requirements, although we are not specialists in transfers for disabled passengers. Disabled passengers using our services must be able to board the vehicle independently or with the assistance of those in their party. We only accommodate foldable wheelchairs. We regret that we cannot currently guarantee the type of vehicle that will be used for your transfer.

6. Amendments & Cancellations 

Amendments

Booking amendments can be made free of charge up to 48 hours prior to the transfer departure by sending an email to our Customer Service at info@transferhop.com or by visiting the “My Booking” section of the website. The changes must quote your booking reference number, lead passenger name and the changes you require. Amendments in less than 48 hours, may result in extra charges that must be paid prior to any changes being made.

For any urgent, last minute amendments (less than 24 hours), you will have to get directly in contact with our emergency helpline, which is stated on your confirmation voucher.

Please be aware that we will try our very best to accommodate all amendment requests. However, we cannot guarantee those, especially for amendments less than 48 hours prior to your service.  

In general, and for most services, we do not charge for amendments or changes to your booking, however we reserve the right to do so in the event the amendment increases the price of your original booking.

Cancellations

Cancellations must be made by you by sending an email to info@transferhop.com.

For any cancellations requests 48 hours prior to your ordered service, following will apply: a) for full prepayments, a cancellation fee of 15% plus the unavoidable bank transaction fee will be deducted and the rest will be refunded to the credit card used for the booking. b) In case of partial payment, 15% of the total amount (minus the unavoidable bank transaction fees) will be deducted and the rest will be refunded.  Should the deposit be less than 15% of the total amount, we will contact you to proceed to the payment of the remaining amount.

For cancellations less than 48 hours prior to your transfer, you will not be entitled to any refund. In the event that you do not use the services for any reason and miss to cancel the booking, no refund will be provided. In case of partial payment, we will contact you to proceed to the payment of the remaining amount.

In the unlikely event that we will be forced to make a significant change in the conditions of service, or to cancel the service, we will make every effort to accommodate your transfer with another provider. Should we finally be forced to cancel your reservation, you will be refunded the full amount of the reservation and this refund will cover all obligations towards the customer arising from such cancellation.

7. No- Show Policy

Driver No-Show Policy

The driver is required to arrive at the pickup location by the scheduled time. If the driver anticipates being up to 10 minutes late, they must notify the traveler via call and text/WhatsApp as soon as possible, but no later than the scheduled pickup time. If the delay is expected to be more than 10 minutes, the driver must inform the company's customer service team in advance, also by the scheduled pickup time. The company's customer service will then contact the traveler and inform them about the expected delay from the driver.

Traveller No-Show Policy

A Traveler No-Show occurs when the traveler is not present at the pickup location by the end of the complimentary waiting time, or any additional waiting time that has been agreed upon by the traveler, the assigned driver, and the company in accordance with the Complementary Waiting Time Policy and the Extra Waiting Time Policy.

The pickup location refers to the designated place where the traveler requests to be picked up from. For airport or port pickups, the Company informs the traveler of the precise pickup location where the driver will be waiting via the booking confirmation email. This location may include specific areas such as the Arrivals hall or Departure hall.

If the traveler does not arrive at the pickup location by the end of their complimentary waiting time, or the end of any additional waiting time agreed upon, or if the driver cannot accommodate an "Extra Waiting Time" request, the transfer is classified as a "Traveler No Show". In such instances, no refund is provided to the traveler. Additionally, if extra waiting time was agreed upon according to the Extra Waiting Time Policy, the traveler is responsible for paying the extra waiting fee.

7. Governing law and jurisdiction

These Terms shall be governed and construed in accordance with the laws of Greece, which governing law applies to agreement without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.       

8. Content

Our website allows you to view information like, text, graphics, videos or other material (“Content”). Content found on our website is the property of TransferHop or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us. Sharable booking links are exempt from the above Content case.

9. Prohibited Uses

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

0.1. In any way that violates any applicable national or international law or regulation.

0.2. To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.

0.3. In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

Additionally, you agree not to:

0.1. Use our website and Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real time activities through Service.

0.2. Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service.

0.3. Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent.

0.4. Use any device, software, or routine that interferes with the proper working of Service.

0.5. Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.

0.6. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Service, the server on which Service is stored, or any server, computer, or database connected to Service.

0.7. Attack Service via a denial-of-service attack or a distributed denial-of-service attack.

0.8. Take any action that may damage or falsify Company ratings.

0.9. Otherwise attempt to interfere with the proper working of Service.

10. Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

11. No Use By Minors

Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.

12. Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to info@transferhop.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

13. Error Reporting and Feedback

You may provide us either directly at info@transferhop.com or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

14. Links To Other Websites

Our Service may contain links to third party web sites or services that are not owned or controlled by TransferHop. TransferHop has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

YOU ACKNOWLEDGE AND AGREE THAT COMPANY SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH USE OF OR RELIANCE ON ANY SUCH CONTENT, GOODS OR SERVICES AVAILABLE ON OR THROUGH ANY SUCH THIRD PARTY WEB SITES OR SERVICES.

WE STRONGLY ADVISE YOU TO READ THE TERMS OF SERVICE AND PRIVACY POLICIES OF ANY THIRD PARTY WEB SITES OR SERVICES THAT YOU VISIT.

15. Disclaimer Of Warranty

THESE SERVICES ARE PROVIDED BY COMPANY ON AN “AS IS” AND “AS AVAILABLE” BASIS. COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK.

NEITHER COMPANY NOR ANY PERSON ASSOCIATED WITH COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. WITHOUT LIMITING THE FOREGOING, NEITHER COMPANY NOR ANYONE ASSOCIATED WITH COMPANY REPRESENTS OR WARRANTS THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

16. Limitation Of Liability

EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD US AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS’ FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY YOU OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF COMPANY HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF COMPANY, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

18. Amendments To Terms

We may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Service.

20. Waiver And Severability

No waiver by Company of any term or condition set forth in Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Company to assert a right or provision under Terms shall not constitute a waiver of such right or provision.

If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.

21. Acknowledgement

BY USING SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
